There are some types of trademarks that are not eligible for trademark protection, they include:
Clearly descriptive marks.  A clearly descriptive mark is one that describes a character or quality of the goods/services with which they are filed. Ex. Sweet Apple Juice of apple juice.

Deceptively misdescriptive marks. A deceptively descriptive mark is one that would mislead consumers into believing that the character or quality of the mark is connected to specific goods/services.

Names or surnames. Unless a name or surname has acquired distinctiveness, they are not usually eligible for trademark protection. There are exceptions to the rule.

Scandalous and immoral marks. If a trademark is perceived to be scandalous or immoral, it is not eligible for trademark protection.

1) Conduct an initial search.  This is one of the most important steps in the process because it will give you an idea of whether or not your trademark is registerable
2) Prepare the trademark application with the proper statement of goods and services. the statement of goods and services is imperative to a properly prepared trademark application
3) Submit the application to the Trademarks Office for examination. This stage involves the examination of the trademark application by an examiner at the Trademarks Office
4) Approval or office action. This stage happens once the trademark application has been examined by an Examiner. You will either receive an approval notice stating that the trademark application has been approved for publication or the Trademarks Office will issue an office action requiring some additional information
5) Publication Trademarks Journal. This step is to enable third parties interested in potentially opposing your trademark application.
6) If no opposition is filed, the trademark application will proceed to allowance and then to registration.  This stage differs depending on where your trademark application has been filed.

This is highly dependent on how you will be using your mark. Theoretically, a word mark mark will provide with a broader scope of protection, however if there are similar marks in the marketplace, then you may have no choice but to file for your logo which could or could not include your word mark. It is important to remember that filing for a logo or a combined trademark will require you to use your logo exactly the way it has been filed.

This will depend on whether or not you are using your business name as a trademark or if you are simply using it as a business name for banking and tax information purposes. If you are using your business name as a trademark, meaning you are selling goods or offering services under this name, then it is highly recommended that you file your business name as a trademark. However, it is important to remember that registration of a business name, does not mean you are protected for the trademark.  Business names and trademarks are not always synonymous

You do not have to have use of your trademark prior to filing your trademark application. In fact, you are best to file a trademark application as soon as possible, as trademarks are examined on a first to file basis.  The sooner your application is in the pipeline, the better off you are.  This means if a third-party files an application after you, your trademark application will take precedence.

An office action is correspondence from the Trademarks Office which sets out that further information is required for the examination of your trademark application or sets out that your trademark application has been refused for not complying with the Trademarks Act.
